By accessing or using PaidByAds ("the Platform," "the Service," "the App"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the service.

1.1 Eligibility

To use PaidByAds, you must:

• Be at least 18 years old
• Have legal capacity to enter into binding contracts
• Provide accurate identity verification information
• Comply with all local, state, and federal laws
• Not be located in a country where the service is prohibited

1.2 Account Requirements

• One account per person (multi-account abuse results in permanent ban)
• Valid email address and phone number for verification
• Government-issued ID for KYC verification
• PayPal account for receiving payments
• Android device running Android 8.0 or higher

3. User Obligations and Conduct

3.1 Attention Verification Requirements

To receive payment for ad viewing, you must:

• Actively watch ads: Your face must be visible to the device camera during ad playback
• Respond to gesture prompts: Complete random verification challenges during ads
• Avoid circumvention attempts: Do not use photos, videos, or AI to simulate attention
• Single user per session: Only the verified account holder may watch ads

To prevent abuse and maintain platform sustainability:

• Daily limit: Maximum 12 hours of ad viewing per day
• Weekly limit: Maximum 5 days of active sessions per week
• Cooling periods: Mandatory breaks between extended sessions
• Quality requirements: Minimum attention scores maintained throughout sessions

Note: These limits exist solely for fraud prevention, not to restrict earning potential. All users have equal access to maximum earning opportunities.

4. Payment Terms

4.1 Payment Processing

• Payment method: PayPal Payouts
• Minimum payout: $10.00 USD
• Payment schedule: Weekly payments every Monday for previous week's earnings
• Processing time: 1-3 business days after payment initiation
• Currency: USD (international users subject to PayPal conversion rates)

4.2 Revenue Calculation

Your earnings are calculated as:

• Base rate per verified ad view (varies by advertiser and ad network)
• Multiplied by your user tier multiplier
• Plus any applicable quality bonuses
• Plus your share of the monthly bonus pool (if applicable)

4.3 Bonus Pool Distribution

When platform revenue exceeds $10 million per month:

• Excess revenue is distributed proportionally to all active users
• Distribution based on verified engagement hours and quality scores
• Transparent calculation displayed in real-time dashboard
• Goal: Create the maximum number of new millionaires

4.4 Withheld Payments

We may withhold payment if:

• Fraud or suspicious activity is detected
• Your account is under investigation
• Your PayPal account information is invalid or inactive
• You violate these Terms of Service
• Legal requirements necessitate withholding

5. Identity Verification and KYC

5.1 Verification Requirements

To withdraw earnings, you must complete:

• Email verification: Confirm your email address
• Phone verification: Two-factor authentication via SMS
• Identity verification: Government-issued ID (driver's license, state ID, or passport)
• Facial verification: Selfie matching your ID photo

5.2 Anti-Money Laundering (AML)

We comply with AML regulations by:

• Monitoring for suspicious transaction patterns
• Reporting large or unusual transactions as required by law
• Maintaining records for regulatory compliance

6. Privacy and Data Protection

Your privacy is governed by our separate Privacy Policy. Key points:

• We collect data necessary for platform operation and payment processing
• Biometric data is processed locally on your device (never uploaded)
• We never sell your personal information
• You have rights to access, correct, and delete your data

7. Intellectual Property

7.1 Platform Ownership

• PaidByAds owns all rights to the app, website, and platform technology
• The PaidByAds name, logo, and branding are proprietary trademarks
• You may not copy, modify, or create derivative works of the platform

7.2 User-Generated Content

By using PaidByAds, you grant us:

• Right to use aggregated, anonymized data for platform improvement
• Right to display your engagement statistics in transparency dashboards
• Right to use testimonials or reviews you provide (with attribution)

8. Disclaimer of Warranties

PaidByAds is provided "as is" without warranties of any kind. We do not guarantee:

• Uninterrupted or error-free service
• Specific earning amounts or income levels
• Availability of advertisements at all times
• Compatibility with all devices or Android versions
• Protection against all forms of fraud or abuse

9. Limitation of Liability

To the maximum extent permitted by law:

• PaidByAds is not liable for indirect, incidental, or consequential damages
• Our total liability to you shall not exceed the amount you earned in the past 90 days
• We are not responsible for third-party services (PayPal, ad networks, etc.)
• You use the platform at your own risk

10. Indemnification

You agree to indemnify and hold harmless PaidByAds from any claims arising from:

• Your violation of these Terms
• Your violation of applicable laws or regulations
• Your fraudulent or abusive behavior
• Your infringement of third-party rights

11. Account Termination

11.1 Termination by User

You may terminate your account at any time by:

• Requesting account deletion in app settings
• Contacting support@paidbyads.com
• Outstanding earnings will be paid out within 30 days

11.2 Termination by PaidByAds

We may suspend or terminate your account for:

• Violation of these Terms
• Suspected fraud or abuse
• Extended period of inactivity (12+ months)
• Legal or regulatory requirements
• Protection of the platform or other users

11.3 Effects of Termination

• Access to the platform immediately revoked
• Pending verified earnings will be paid (minus any fees owed)
• Fraudulent earnings will be forfeited
• You may not create new accounts after termination

12. Dispute Resolution

12.1 Informal Resolution

Before filing a claim, contact us at support@paidbyads.com to attempt informal resolution. We commit to good-faith negotiations for 60 days.

12.2 Binding Arbitration

If informal resolution fails:

• Disputes shall be resolved through binding arbitration
• Governed by the American Arbitration Association (AAA) rules
• Arbitration conducted in Little Rock, Arkansas
• You waive the right to a jury trial
• You waive the right to participate in class action lawsuits

12.3 Exceptions

The arbitration requirement does not apply to:

• Small claims court disputes (under $10,000)
• Injunctive relief for intellectual property violations
• Emergency provisional remedies

13. Governing Law

These Terms are governed by the laws of the State of Arkansas, United States, without regard to conflict of law principles.

14. Changes to Terms

We may modify these Terms at any time:

• Material changes require 30 days advance notice
• Notice provided via email and in-app notification
• Continued use after changes constitutes acceptance
• If you disagree with changes, you may terminate your account

If any provision of these Terms is found invalid or unenforceable, that provision shall be modified to reflect the parties' intention, and the remaining provisions shall remain in full effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PaidByAds, superseding any prior agreements or understandings.
